Burnsville Sports Bar Disturbance Leads to Arrest and Multiple Charges
BURNSVILLE, MINNESOTA - A man is facing multiple charges after an incident at a Burnsville sports bar escalated into alleged threats, racial slurs, and an assault on a law enforcement officer, according to a probable cause statement and charging documents filed in Dakota County District Court.
On September 10, 2025, at about 9:14 p.m., Burnsville police officers were dispatched to the Racks Sports Bar off Highway 13 and Cliff Road, following reports of a disturbance. According to the probable cause filing, a patron purchased a beer with a debit card, followed a female employee into the kitchen area, and asked for her phone number. When she declined, he allegedly began swearing and causing a disruption.
The bar manager intervened and, per the statement, the man struck the manager’s hand, made multiple threats, including racial slurs, and said he would retrieve a “9mm Glock.” Surveillance video corroborated employees’ accounts, the filing states. The man then left the bar.
A KOPS alert was issued, and at about 10:07 p.m., deputies located the suspect driving into a bar parking lot in Apple Valley, where he was taken into custody.
During transport to the Dakota County Jail, the man allegedly directed racial slurs and threats toward a deputy. Upon arrival, he allegedly spat at the deputy, with saliva striking the deputy’s face. The probable cause filing states he continued attempting to spit and make threats after being restrained, and a spit hood was placed on him. He also refused to submit to a breath test after being read the Implied Consent Advisory. Court records note one prior DWI-related implied consent revocation within the past 10 years.
The suspect was identified as 44-year-old Jason Roman Gerardy of Rosemount, Minnesota. According to Dakota County District Court filings, the defendant has been charged with:
Count I – Threats of Violence (Intent to Terrorize), Felony — Minn. Stat. 609.713.1
Count II – Threats of Violence (Intent to Terrorize), Felony — Minn. Stat. 609.713.1
Count III – Assault in the 4th Degree (Peace Officer) — Transfer Bodily Fluids, Felony — Minn. Stat. 609.2231.1(c)(2)
Count IV – 2nd Degree DWI (Refusal/Breath, Aggravating Factor), Gross Misdemeanor — Minn. Stat. 169A.20.2(1), referencing 169A.25.1(b), 169A.25.2
Bail Request and Court Ruling
According to a September 12, 2025, bail request filed by the Dakota County Attorney’s Office, prosecutors asked for bail to be set at $150,000 without conditions or $75,000 with conditions, citing the defendant’s behavior and public safety risks. Proposed conditions included:
Exclusion from all bars in Dakota County, including Racks Sports Bar
Enrollment in the Pretrial Release Program
Electronic home monitoring with alco-sensor
No use or possession of alcohol or controlled substances
Random chemical testing
Remaining law-abiding and attending all future court appearances
Keeping the court and attorney updated on the current address
The request noted that the defendant has an active civil commitment, a pending terroristic threats case involving prior racial comments and threats. Prosecutors argued bail was warranted due to the danger posed to the public and law enforcement. Court records show that bail was ultimately set at $80,000 without conditions or $20,000 with conditions on September 12, 2025.
This report is based on a probable cause statement, charging documents, and bail filings submitted in Dakota County District Court.
