Man Arrested After Hiding in Eagan Attic Charged with Burglary, Protection Order Violation
UPDATE - 12:30 AM on May 16, 2025: The man arrested Tuesday night, May 13, 2025, after a large-scale police search in Eagan has been formally charged with felony burglary and violating an order for protection, according to a criminal complaint filed Thursday by the Dakota County Attorney’s Office.
Wayne Bracy Jr., 47, of Eagan, is accused of unlawfully entering a residence on the 1000 block of Trillium Court and hiding in the attic following a foot chase with police. The incident unfolded around 9:20 p.m. on May 13, when officers responded to reports that Bracy had violated a harassment restraining order (HRO) by coming near a protected individual’s home.
According to the complaint, the victim—identified only as Victim 1—told officers her dog alerted her to Bracy's presence outside the residence. Surveillance footage confirmed Bracy’s arrival in a black Dodge Charger. The victim also showed police threatening text messages she believed were sent by Bracy, including a video depicting a handgun being fired from a vehicle.
Police located the suspect’s vehicle in the parking lot of the Cub grocery store nearby and spotted a man matching Bracy’s description fleeing on foot. Multiple officers, including a K9 team and drone unit, were deployed in a coordinated search effort. Bracy was eventually located inside the attic of a home on Trillium Court, where residents reported seeing an unknown man. Officers used a drone to locate Bracy by flying it into the attic where he allegedly threw objects at it before eventually surrendering at approximately 10:46 p.m.
Court records state that Bracy actively resisted arrest by concealing his hands under his body before officers were able to detain him.
Bracy is charged with:
Burglary in the 2nd Degree (Dwelling) – a felony punishable by up to 10 years in prison and a fine up to $20,000.
Violation of an Order for Protection – a misdemeanor punishable by up to 90 days in jail and a fine up to $1,000.
He was being held in custody and is subject to a Domestic Abuse No Contact Order (DANCO) prohibiting contact with the victim or entry into her residence. Bail has been set at $20,000 without conditions or a non-cash bond of $5,000 with several conditions, including participation in a pretrial release program, remaining in Minnesota, and staying law-abiding. He might have posted a cash bail of $500 with conditions, but are working to confirm those details.
Bracy's next court appearance is set for June 3, 2025, at 1:30 pm in Hastings, MN.
