EAGAN, MN - A former controller for an Eagan business has been charged with three felony counts of theft by swindle after prosecutors accused him of using company funds for approximately $158,707.60 in unauthorized personal expenses, including home improvements, vehicle payments, a vacation rental and electronics.

Todd Michael Tibesar, 44, is accused of obtaining the funds between October 2023 and November 2024, according to a criminal complaint filed in Dakota County District Court.

According to the complaint, Eagan police received a report of suspected embezzlement on November 24, 2025, after the business discovered financial irregularities following Tibesar's resignation. Tibesar submitted his resignation on March 25, 2025, with his final day of employment listed as May 12, 2025.

The business reported discovering payments for improvements to Tibesar's personal residence, an Airbnb rental during a vacation and personal electronics that had allegedly been paid for using company funds.

Investigators received financial records from the business on February 20, 2026, including invoices for work performed at Tibesar's residence. According to the complaint, an IT specialist recovered several records that had been deleted on September 23, 2024. The company's system history reportedly identified Tibesar as the person who deleted the files.

The complaint identifies approximately $16,178.56 in unauthorized expenditures between October 2023 and January 2024, including payments for a personal vehicle wrap and a down payment for garage door work at Tibesar's residence.

Between March and July 2024, investigators identified additional transactions involving home improvements and a payment toward Tibesar's personal vehicle loan.

According to the complaint, a company check totaling $66,891.89 was issued to Porsche Financial Services on May 16, 2024, to pay off the vehicle loan. The business reported that Tibesar had been authorized to apply a $50,000 bonus toward the loan, but the payment exceeded the approved amount.

The business also reported that Tibesar had been authorized to use a separate $50,000 bonus for home window improvements. However, investigators identified expenditures exceeding the approved amount.

After accounting for the authorized bonuses, prosecutors allege approximately $113,947.26 in unauthorized expenditures occurred between March and July 2024.

Additional transactions between August and November 2024 allegedly included more than $24,000 in concrete work at Tibesar's residence, a $2,281.47 Airbnb stay during personal time off and purchases of computers from Best Buy and Micro Center.

Those transactions totaled approximately $28,581.78, according to the complaint.

The business told investigators that Tibesar's position overseeing company finances allowed him to process invoices and payments for the personal expenses.

Investigators also learned that Tibesar had submitted a $50,000 bonus for himself on February 28, 2025, alongside bonuses for other employees. The business reported that the bonus was unauthorized. The complaint does not specify whether that additional bonus was paid.

Tibesar faces two felony counts of theft by swindle involving amounts exceeding $5,000, each carrying a maximum sentence of 10 years in prison and/or a $20,000 fine under Minnesota Statute 609.52.

He also faces one felony count involving an amount exceeding $35,000, which carries a maximum sentence of 20 years in prison and/or a $100,000 fine.

The charges are allegations, and Tibesar is presumed innocent unless and until proven guilty in court.
