Fargo Man Facing Charges After High-Speed Pursuit From Mystic Lake; Preliminary BAC .275, Police Say

PRIOR LAKE & EDINA, MINNESOTA: A Fargo man with a prior felony DWI conviction and an active out-of-state warrant is facing multiple new charges after allegedly fleeing police in a high-speed pursuit from Mystic Lake Casino and registering a preliminary blood alcohol content of .275, according to a criminal complaint filed in Scott County District Court.
Intoxicated Passenger Turns Driver After Warning From Police
On November 25, 2025, at approximately 3:29 p.m., Prior Lake Police were dispatched to Mystic Lake Casino for a report of an intoxicated woman found lying in the grass near the property. Officers located the 24-year-old woman of North Dakota and instructed her to obtain a sober ride. Security personnel later reported that she had entered the driver’s seat of a Ram pickup in the casino’s main parking lot.
When officers arrived at the vehicle, they found two passengers, Leroy Lee Foster, 37, of Fargo, ND (front passenger), and a 33-year-old unidentified rear passenger also of Fargo, ND.
Police reported that Foster allegedly exhibited signs of intoxication, including bloodshot, watery eyes and a strong odor of alcohol. When asked whether anyone in the group was sober enough to drive, Foster allegedly replied, “not sober enough to drive, no.” Officers instructed the group to leave the property and obtain a sober driver.
Foster Accused of Driving Away, Triggering Pursuit
Minutes later, officers were re-dispatched after receiving reports that Foster was now allegedly driving the vehicle despite his earlier admission. Police located the Ram pickup at a stoplight on Flandreau Trail. When an officer activated emergency lights to initiate a traffic stop, the vehicle accelerated northbound on Mystic Lake Drive at 60–70 mph, with a female passenger on board.
Shakopee Police joined the pursuit as the vehicle entered northbound Highway 169. A records check revealed Foster had a felony probation-violation warrant out of Nevada for a dangerous drugs conviction and an alert for violent tendencies. The pursuit continued at 60–80 mph until Edina Police successfully deployed stop sticks near Highway 494. The vehicle’s front tires were punctured, and it came to a stop shortly thereafter near Highway 169 and Highway I-494.
High BAC, Refusal to Test & Suspended License
Officers ordered Foster out of the vehicle at gunpoint. He allegedly complied, lying on the ground before being taken into custody. Police noted an alleged “very strong odor of alcoholic beverage” and continued physical signs of impairment. Foster allegedly refused an initial preliminary breath test but later agreed to provide a sample, which returned a result of .275 BAC, more than three times the legal limit.
At the Scott County Jail, Foster consulted an attorney. Still, he ultimately refused the official DMT breath test, allegedly telling officers he declined because he believed they had given him the option to refuse.
A state records check confirmed that Foster’s driver’s license was suspended, and he had a prior felony DWI conviction from 2015 in Clay County, North Dakota.
Felony & Misdemeanor Charges Filed
Foster is now charged with the following offenses:
Count I — Felony: Fleeing a Peace Officer in a Motor Vehicle
Punishable by up to 3 years and 1 day imprisonment and/or a $5,000 fine.
Count II — Gross Misdemeanor: Second-Degree DWI – Test Refusal
Punishable by up to 1 year imprisonment and/or a $3,000 fine.
Count III — Gross Misdemeanor: Third-Degree DWI – Under the Influence of Alcohol
Enhanced due to one aggravating factor.
Count IV — Misdemeanor: Driving After Suspension
Punishable by up to 90 days in jail and/or a $1,000 fine.
Additional Warrant
Authorities note that Foster is also wanted on a Nevada felony probation-violation warrant, which may lead to further legal consequences.
Case Status
The investigation into the incident remains open. Foster was being held at the Scott County Jail, but court records show that on November 26, 2025, he was released from Scott County Jail for personal reconginance.
