Woman Charged With Felony DWI After Police Allegedly Find 21 Grams of Suspected Fentanyl

BLAINE MN: A Blaine traffic stop led to felony DWI and drug charges after police allegedly found more than 20 grams of suspected fentanyl on a woman who has three prior DWI convictions within the past 10 years, according to an Anoka County criminal complaint.
Amber Elaine May, 31, is charged with two counts of felony first-degree DWI, felony third-degree controlled substance possession and gross misdemeanor driving after cancellation as inimical to public safety.
According to the complaint, Blaine police officers spotted a dark Honda Ridgeline merging onto eastbound Highway 10 on Sept. 29 without a visible license plate. Officers eventually observed what appeared to be a temporary tag in the rear window but said they initially could not read it because of the darkness and window tint.
Police initiated a traffic stop and identified May as the driver.
The complaint alleges an officer observed May stumbling and slurring her words, with glossy eyes, delayed responses and lethargic mannerisms. Police also reported seeing wisps of smoke coming from the vehicle and smelling marijuana.
May allegedly told officers she had used marijuana about an hour before driving. Police determined her driver's license was canceled, according to the complaint.
During field sobriety testing, May allegedly appeared confused while officers explained the walk-and-turn test and declined to complete it. During a one-leg stand test, police said she swayed and put her foot down multiple times.
A preliminary breath test registered .000, according to the complaint.
After May was arrested, officers allegedly found several bags and containers containing suspected narcotics on her person. Two samples field-tested positive for fentanyl, and police reported that the suspected fentanyl-containing substances collectively weighed approximately 21.02 grams with packaging.
Police also allegedly recovered 36 pills believed to be alprazolam, a Schedule IV controlled substance. A subsequent search of the vehicle allegedly uncovered several small bags of marijuana and drug paraphernalia.
May was taken to Unity Hospital, where police presented her with a search warrant for a blood or urine sample. She provided a blood sample, and the complaint states laboratory results were still pending when charges were filed.
Court records cited in the complaint show May has three gross misdemeanor DWI convictions within the previous 10 years: a 2020 conviction in Itasca County, a 2021 conviction in Cass County and a 2022 conviction in Beltrami County.
The complaint also states May currently has a separate felony DWI case pending in Ramsey County.
The two DWI counts in the Anoka County case are charged as felonies based on the alleged offense and May's prior impaired-driving history. The third-degree controlled substance charge alleges possession of at least five grams of a mixture containing fentanyl.
The charges are allegations. May is presumed innocent unless and until proven guilty in court.
