Man Charged After Allegedly Fleeing SWAT With Meth, Psilocybin Mushrooms in Backpack

HASTINGS MN - A man is facing two felony drug charges after authorities say he fled from officers and was apprehended by SWAT while carrying a backpack containing a lunch box with more than 50 grams of suspected methamphetamine and nearly 18 grams of suspected psilocybin mushrooms.
Beau James Sebastian, 47, has been charged in Dakota County District Court with second-degree controlled substance possession involving 25 grams or more of cocaine or methamphetamine as a subsequent controlled substance offense, along with fifth-degree controlled substance possession.
According to the criminal complaint, agents from several law enforcement agencies went to a residence on the 200 block of Cari Park Lane in Hastings at approximately 3 p.m. on Aug. 10 to arrest Sebastian on an active Minnesota Department of Corrections warrant.
Authorities allege Sebastian fled out the rear of the residence as officers approached, where SWAT officers positioned behind the residence apprehended him.
Investigators said Sebastian was wearing a backpack when he was arrested. Inside the backpack, authorities allegedly found a lunch box containing approximately 51.41 grams of a substance that field-tested positive for methamphetamine and approximately 17.98 grams of a substance that field-tested positive for psilocybin.
The complaint states the backpack also contained a cellphone, plastic baggies, a scale, rubber bands and $2,000 in cash.
Prosecutors allege the second-degree charge constitutes a subsequent controlled substance offense because Sebastian was previously convicted in 2019 of violating Minnesota's second-degree controlled substance statute.
Minnesota Department of Corrections records list Sebastian as under supervision through Dakota Community Corrections, with an expiration date of Dec. 13, 2026. DOC records list drugs as his highest-ranked offense and reference Dakota County court file 19HA-CR-18-2558.
The second-degree controlled substance charge carries a maximum sentence listed in the complaint of 40 years in prison and/or a $500,000 fine. The fifth-degree charge carries a maximum sentence of five years and/or a $10,000 fine.
The allegations contained in the criminal complaint are accusations. Sebastian is presumed innocent unless and until proven guilty in court.
