Hennepin County Attorney’s Office Says No Charges Were Filed Against Carlton Johnson After June Gun Incident

MINNEAPOLIS MN: The Hennepin County Attorney’s Office has released additional information regarding its review of a June incident involving Carlton Neal Johnson, saying prosecutors determined there was insufficient evidence to pursue criminal charges or an Extreme Risk Protection Order.

According to a statement from Hennepin County Attorney Mary Moriarty, Minneapolis police responded on June 25 to a report that Johnson had displayed a firearm to another person.

Police investigated the incident and determined Johnson had a valid permit to carry a firearm. According to the County Attorney’s Office, Johnson displayed the weapon, but it did not leave his waistband.

The Minneapolis Police Department submitted the case to the Hennepin County Attorney’s Office for review on Aug. 20.

The office said the case was quickly reviewed by an experienced attorney under established protocols. Prosecutors ultimately determined the case likely could not be charged because there was insufficient evidence to prove a criminal charge beyond a reasonable doubt.

The County Attorney’s Office also said Johnson’s conduct was flagged for screening under Minnesota’s Extreme Risk Protection Order process, commonly known as an ERPO.

After an additional review, the office determined there was also insufficient evidence to petition the court for an ERPO based on the June 25 incident.

The statement was released by the Hennepin County Attorney’s Office as it provided details about the previous incident and its response involving Johnson.
