The charge carries a maximum penalty of up to 30 years in prison, a $40,000 fine, or both.

The second count, third-degree criminal sexual conduct, alleges McNerthney used coercion to accomplish sexual penetration, in violation of Minnesota Statute 609.344.1(a). That charge carries a maximum sentence of up to 15 years in prison, a $30,000 fine, or both.

McNerthney is presumed innocent unless and until proven guilty in a court of law.
