Rosemount Woman Charged After Allegedly Pointing Rifle at Adults, Child Outside Restaurant

ROSEMOUNT - A Rosemount woman is facing two felony assault charges after authorities allege she retrieved a rifle and pointed it toward people outside a local restaurant, where a group of elementary-aged children had gathered to celebrate the end of their football season.

Rachael Rene Hollatz, 46, has been charged in Dakota County District Court with two counts of second-degree assault with a dangerous weapon. Prosecutors allege a .22-caliber rifle was used during the Oct. 3 incident.

According to the criminal complaint, Rosemount police responded to a report of a woman pointing a gun at people outside a restaurant.

Investigators learned a group of elementary-aged boys had been at the restaurant celebrating the end of their football season. Some of the children were outside playing football near the restaurant's patio when Hollatz, who lived in a nearby apartment building, allegedly yelled at them to "shut up."

The father of one of the children told police he spoke with Hollatz after learning she had been yelling at the group. According to the complaint, Hollatz appeared upset and complained that children had "no respect" and had been calling her names.

The father reportedly directed the children to return inside the restaurant and went back inside himself.

One of the children later became upset after realizing he had left candy and a yo-yo outside. According to prosecutors, the child's mother accompanied him outside to retrieve the items.

The complaint alleges that while the mother and child were bent over picking up the candy, the mother looked up and saw Hollatz with a gun raised and pointed in their direction. The mother and child then ran back into the restaurant.

After learning what had allegedly happened, the father went outside and yelled at Hollatz to stop, according to the complaint. Prosecutors allege Hollatz then turned and pointed the gun directly at him, prompting him to return inside.

During a Mirandized interview with police, Hollatz allegedly acknowledged becoming upset with the children and said they would not listen to her.

According to the complaint, Hollatz became emotional during the interview and told police she was "stupid" and "shouldn't have done anything else."

Hollatz allegedly told investigators she grabbed her father's gun and unloaded it before leaving the apartment building with the firearm. She admitted wanting to scare the group, according to prosecutors, but denied pointing the rifle directly at anyone. She maintained that the firearm was pointed either toward the ground or into the air.

Police later obtained a search warrant for Hollatz's apartment and reported finding a .22-caliber rifle.

Each second-degree assault charge is a felony. The complaint cites Minnesota's firearm sentencing provisions in connection with both counts.

Prosecutors also stated that they intend to seek an aggravated sentence based on their allegation that the offenses were committed in the presence of a child.

The allegations contained in a criminal complaint are accusations. Hollatz is presumed innocent unless and until proven guilty in court.
