South St. Paul Woman Charged After Allegedly Spitting on Officers During Arrest

SOUTH SAINT PAUL: A South St. Paul disturbance call led to a felony assault charge after a woman allegedly spit on two police officers while being taken into custody, according to a Dakota County criminal complaint.
Jamie Merrine Holmes, 42, is charged with felony fourth-degree assault of a peace officer involving the transfer of bodily fluids in connection with the Aug. 21 incident.
According to the complaint, South St. Paul police were dispatched to a residence after a caller reported that his ex-girlfriend, identified as Holmes, was intoxicated and screaming in the backyard.
When officers arrived, the reporting party told police he had returned from a walk and was informed by neighbors that Holmes had been screaming. Officers allegedly saw Holmes enter the residence and lock the doors.
The homeowner was eventually able to enter the residence and let officers inside, according to the probable cause statement. Police determined Holmes had outstanding warrants and placed her under arrest.
While officers were conducting a search following the arrest, Holmes allegedly became argumentative and blew spit toward the officers. The complaint alleges the spit struck one officer in the face and another officer on the arm.
Holmes is charged under Minnesota law with fourth-degree assault of a peace officer for allegedly intentionally transferring bodily fluids onto an officer.
The allegations contained in the criminal complaint have not been proven in court. Holmes is presumed innocent unless and until proven guilty.
