Two charged after Prior Lake crash involving stolen Eagan vehicle; guns recovered, complaint says

PRIOR LAKE MN: Two young men are facing charges after a crash involving a stolen vehicle led police to recover firearms and drugs in Prior Lake, according to criminal complaints filed in Scott County.

The criminal complaints outline the following account of the March 3 incident.

According to the criminal complaints, Prior Lake police officers were dispatched around 10:56 p.m. to a report of a crash near 140th Street and Eagle Creek Avenue. A caller reported a vehicle had gone into an embankment and that someone had exited the vehicle.

When officers arrived, they found a heavily damaged vehicle down an embankment in a wooded area off the roadway. Police identified a man near the vehicle as Daimyn Robert Senn, 19.

Investigators said Senn appeared injured and had slurred speech and drooping eyelids. During a search, officers reported locating an orange pill bottle containing three pills identified as alprazolam (Xanax) along with a green leafy substance that field-tested positive for synthetic cannabinoids, also known as K2 or Spice.

Senn told officers he did not remember what happened and said he was not the driver of the vehicle. He was transported to St. Francis Regional Medical Center for treatment.

The vehicle — a 2016 Nissan Maxima — had extensive damage, including shattered windshields and a tire torn off the axle. Officers also observed blood on the steering wheel and airbags.

Police ran the license plate and learned the vehicle had been reported stolen earlier that day in Eagan.

While checking the vehicle for additional occupants, officers reported locating multiple firearms inside, including a Glock 19 with an extended magazine and another handgun described in court documents as a Polymer80-style firearm with a drum magazine. Investigators said the firearms had devices attached that could allow them to fire automatically.

Police also recovered ammunition, three cell phones and a key fob believed to belong to the vehicle.

Officers used a thermal drone to search the surrounding area for additional people who may have been involved in the crash but did not locate anyone at that time.

While officers were still at the crash scene, dispatch received calls about a man ringing doorbells and asking for help in a nearby neighborhood.

Officers responded to a residence on Coachman Lane, where they located Desmon Demond Burks Jr., 18, on a front porch.

Police said Burks appeared intoxicated and had facial injuries consistent with being involved in a vehicle crash. Burks told officers he had been assaulted near a Holiday gas station on County Road 42 and was trying to get a ride home after being dropped off from a blue Nissan.

During a pat search, officers located a key fob believed to be associated with the stolen vehicle.

Burks was transported to St. Francis Regional Medical Center. While he was being taken to the hospital, paramedics reportedly located a handgun concealed in his underwear, described in court documents as a firearm without a serial number.

Investigators said Burks allegedly commented that if he had ammunition he would have “used it.”

Both men were later cleared by hospital staff and transported to the Scott County Jail.

Senn is charged with possession of a machine gun or machine gun conversion device, possession of a firearm with an altered serial number, receiving stolen property, fifth-degree controlled substance possession and carrying a pistol without a permit.

Burks is charged with possession of a machine gun or machine gun conversion device, possession of a firearm with an altered serial number, receiving stolen property and carrying a pistol without a permit.

Court records show Burks previously had juvenile adjudications in Hennepin and Ramsey counties involving firearm-related offenses, including firearm possession cases.

The charges are allegations, and both men are presumed innocent unless and until proven guilty in court.
