A Woman is Facing Charges for Second-Degree DWI After Allegedly Driving Over Twice the Legal Limit with a Child in the Vehicle

Published: April 21, 2026

LAKEVILLE, MINNESOTA - A woman from Burnsville is facing multiple charges in Dakota County after allegedly driving under the influence of alcohol at more than twice the legal limit while a young child was in the vehicle.

According to a criminal complaint filed in Dakota County District Court, Victoria Lee Sickler, 31, has been charged with two counts of second-degree driving while impaired (DWI), along with additional misdemeanor charges, including possession of an open bottle and failure to maintain a single lane.

Traffic Stop in Lakeville

The charges stem from an incident on the evening of April 18, 2026, in Lakeville.

According to the complaint, a Lakeville police sergeant observed a vehicle traveling northbound on Dodd Boulevard near 207th Street West that crossed over the double yellow line twice. The vehicle was later seen turning onto Kenwood Trail, where it again crossed lane markings and made sharp corrections.

A traffic stop was conducted, and the driver was identified as Sickler.

Signs of Impairment Observed

Court documents state that officers detected a strong odor of alcohol coming from the vehicle. Sickler reportedly had bloodshot, watery eyes and slow, slurred speech.

Sickler agreed to perform field sobriety tests but was unable to complete them satisfactorily. A preliminary breath test (PBT) reportedly showed a blood alcohol concentration (BAC) of 0.208. She was subsequently arrested.

After being taken into custody, Sickler agreed to a formal breath test, which indicated a BAC of 0.23, nearly three times the legal limit of 0.08 in Minnesota.

During a search of the vehicle, officers also located an open bottle of Captain Morgan rum, approximately three-fourths full, near the driver’s seat.

Child in the Vehicle

Authorities reported that a young child, identified as Sickler’s infant son, was in a car seat in the back of the vehicle at the time of the stop.

The presence of a child, along with a prior impaired driving-related incident on Sickler’s record, contributed to the aggravating factors that elevated the charges to second-degree DWI.

Charges Filed

Sickler is charged with:

  • Two counts of Second-Degree DWI (gross misdemeanor)

  • Open Bottle Violation (misdemeanor)

  • Failure to Drive in a Single Lane (misdemeanor)

Each gross misdemeanor DWI charge carries a maximum penalty of up to 364 days in jail and/or a $3,000 fine.

Court Conditions and Bail

According to court records, Sickler may be held on $12,000 bail without conditions or released without bail under strict conditions, including the use of an alcohol monitoring system prior to release, no use or possession of alcohol or controlled substances (except prescribed medications), and no driving without a valid license and insurance. As of the writing of this article, Sickler had not posted bail and remained in custody at the Dakota County Jail.

As with all criminal cases, the defendant is presumed innocent until proven guilty in a court of law.
