According to a criminal complaint filed in Hennepin County District Court, Charles Henry Foss is accused of causing the woman's death in February 2024 following a history of alleged domestic violence.
Foss faces one count of second-degree murder without intent while committing a felony and one count of felony stalking. The murder charge carries a maximum sentence of 40 years in prison, while the stalking charge carries a maximum sentence of 10 years and/or a $20,000 fine.
According to the statement of probable cause, Minneapolis police responded to an apartment on February 22, 2024, after a woman was discovered deceased during a welfare check.
The Hennepin County Medical Examiner's Office determined that the woman died from a head injury. Investigators believe her death occurred several days before she was discovered.
Court documents indicate that Foss and the woman had been involved in an on-and-off romantic relationship for approximately three years.
Investigators reviewed communications between Foss and the woman, along with statements from family members, friends and acquaintances, to establish a timeline leading up to her death.
According to the complaint, the woman last communicated with family members on February 18, 2024. Investigators determined that activity on her phone and social media accounts stopped later that evening.
Prosecutors allege that Foss subsequently made statements to multiple acquaintances admitting responsibility for the woman's death.
One witness reportedly told investigators that Foss admitted to killing his girlfriend during a conversation on February 19, 2024. Another acquaintance reported that Foss made a similar admission several days later.
The complaint also outlines a history of alleged domestic violence dating back to March 2021. Investigators reviewed police reports, medical records, statements from family members and previous petitions for orders for protection.
On February 13, 2024, just days before the woman's death, Minneapolis police responded to a reported domestic assault involving Foss. Officers documented injuries to the woman, according to the complaint.
Police were also called to the woman's apartment on February 17 after she reported that Foss was refusing to leave. Responding officers located Foss inside and escorted him from the building.
Foss is currently serving a prison sentence for crimes connected to a separate incident on July 30, 2024.
According to the complaint, officers encountered Foss driving a stolen vehicle that day. Foss allegedly fled from police, struck a squad car and entered a nearby residence without permission.
Authorities reported that Foss threatened occupants of the residence with a knife before barricading himself inside for several hours. Foss eventually surrendered and was taken into custody.
The complaint states that Foss is currently incarcerated for crimes committed during that incident, which included burglary and fleeing police.
The new murder and stalking charges are separate from those convictions.
The allegations in the new criminal complaint have not been proven in court. Foss is presumed innocent of the new charges unless and until proven guilty.
