Shakopee Resident Charged with First- and Second-Degree Criminal Sexual Conduct

SCOTT COUNTY: A 42-year-old Shakopee man is facing felony charges in Scott County District Court following allegations of criminal sexual conduct involving a minor over whom he held a position of authority.
According to court records, Jeffrey Earl Holmberg (DOB: 03/15/1983) has been formally charged by Scott County prosecutors in connection with a law enforcement investigation.
Count I: Criminal Sexual Conduct – 1st Degree (Felony)
Statute: Minn. Stat. § 609.342.1(a) / § 609.342.2(a)
Allegation: Prosecutors allege that between January 1, 2018, and December 31, 2021, Holmberg engaged in sexual penetration with a complainant who was at least 13 but less than 16 years of age. The complaint states Holmberg was more than 48 months older than the victim and occupied a position of authority.
Maximum Sentence: Up to 30 years imprisonment, a fine of up to $40,000, or both.
Count II: Criminal Sexual Conduct – 2nd Degree (Felony)
Statute: Minn. Stat. § 609.343.1(a) / § 609.343.2(a)
Allegation: The complaint alleges that between January 1, 2024, and January 1, 2025, Holmberg engaged in sexual contact with a victim who was at least 13 but less than 16 years of age, while acting in a position of authority and being more than 48 months older. Minnesota law notes that neither mistake as to the complainant's age nor consent to the act constitutes a legal defense.
Maximum Sentence: Up to 25 years imprisonment, a fine of up to $35,000, or both.
